You say the original T.H.U.N.D.E.R. Agents run isn't PD, yet several sources including Public Domain SuperHeroes Wiki and the experts at Digital Comics Museum all say otherwise.
The Comics Journal (I trust you've heard of them) also provided the following background info in issues running from #99 thru #105...
The judge threw out Carbonaro's initial copyright claim.
JC then appealed, and added all the comics distributors who were carrying WWTA to the defendant list.
Since JC was using a Volunteer Lawyers for the Arts-assigned lawyer, all the legal maneuvering wasn't costing him a cent.
Plus, because he had to plead poverty to get a VLA lawyer, even if Singer and the distributors had won, they'd still be out court costs and lawyers' fees for their own defenses with no way to recoup from the indigent Carbonarro.
The distributors decided the fight wasn't worth it, and dropped Deluxe Comics.
Singer decided to settle, rather than lose money even if he won.
That, in no way, affected the actual legal status of the original series' copyrights.
While Carbonarro did trademark the name, later on, the original series is still PD.
